5. This Site may reference or link to other sites on the Internet which are owned and operated by ToolTwist's suppliers, customers and other third parties. ToolTwist has no control over these sites or the content within them. ToolTwist cannot and does not guarantee, represent or warrant that content posted in these sites is accurate, legal and/or inoffensive. ToolTwist does not endorse the content of any third-party site, nor does ToolTwist warrant that they will not contain viruses or otherwise impact your computer. By using this Site to search for or link to another site, you agree and understand that you may not make any claim against ToolTwist for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or link to another site.
6. The Site is created and controlled by ToolTwist in Hong Kong. As such, the laws of Hong Kong will govern these terms and conditions of use, without giving effect to any principles of conflicts of laws. Except for actions for preliminary injunctive relief and actions to enforce the decisions of the arbitrators, all disputes arising out of or related to your use of the Site, as well as the scope, application, interpretation and construction of the terms and conditions of use of the Site, shall be resolved by arbitration in accordance with the commercial arbitration rules of Hong Kong then in force. The arbitration hearings and all meetings pursuant to this section shall be held in Hong Kong. If you and ToolTwist cannot agree upon a single arbitrator within 15 days after you or ToolTwist demands arbitration, you and ToolTwist shall select one arbitrator knowledgeable of the computer service industry and the World Wide Web and notify the other of its selection, and such two arbitrators shall select a third. The arbitrator(s) shall conduct a hearing within 30 days after their selection. A majority of the arbitrators shall determine the decision/award, which shall be rendered within five days after the completion of the hearing. The decision of the arbitrator(s) shall be final and binding upon the parties both as to law and to fact, and shall not be appealable to any court in any jurisdiction. The expenses of the arbitrators shall be shared equally by you and ToolTwist.
7. ToolTwist reserves the right to make changes to the Site and these terms and conditions at any time.
